Care for Friends Program - Terms and Conditions

THE TERMS AND CONDITIONS LISTED BELOW AND GENERAL CARE ACCESS POLICIES ON THIS WEBSITE, INCLUDING THE CARE ACCESS PRIVACY POLICY, APPLY TO YOUR PARTICIPATION IN THE CARE FOR FRIENDS REFERRAL PROGRAM.

The Care for Friends Program (the “Program”) permits Care for Friends Champions to earn money (see Payment section below) by referring to Care Access Research LLC (“Care Access”) eligible new (first time) participants (“Qualified Referrals”) who provide consent to join a Care Access health screening program or eligible study.

To participate, Champions must agree to these Terms, and by participating you agree to these Terms. The Program may not be combined with other Care Access referral programs or incentives.

Eligible Qualified Referrals.

  • A Qualified Referral is an eligible participant who (1) clicks on your active referral link; (2) is new to Care Access; and provides consent to participate in the Care Access Future of Medicine Program or a Study.
  • Eligible Qualified Referrals do not include participants already in the Care Access participant database for Future of Medicine or any study.
  • A Qualified Referral will be associated only with the first Champion referral link used. Multiple referral links or multiple entries or registrations for the same person are not permitted. If a Qualified Referral does not use your link, then you will not be compensated.
  • Study Qualified Referrals. Care Access will select studies to be part of the Program, at its sole discretion.

Champion Obligations

  • You must be truthful and may not be misleading about Care Access, any health screening programs or any studies.
  • In any personal endorsement, you must be transparent that you are a Care for Friends Champion who receives compensation for referrals.
  • You agree that you will comply with all applicable laws.
  • You agree to keep any personal health information you learn about others as a Care Access Champion confidential.

Additional Program Restrictions

  • Referral links should not be published or distributed where there is no reasonable basis for believing that all or most of the recipients are your personal friends and family members. (For example, you should not post general posters on community boards or make posts on coupon websites, Reddit, or other general websites that extend beyond your personal network).
  • You may not represent yourself as an employee, intermediary or agent, or as being authorized to bind (make promises or contracts on behalf of) Care Access. You are not permitted to imply any affiliation with Care Access beyond your limited role as a Champion.
  • You may not create materials (including business cards, websites, or email addresses) about Care Access studies or programs, bearing Care Access branding, or that imply any affiliation or agency relationship between you and Care Access beyond the limited Champion role.
  • Champions may NOT register people into this program. Potential participants are the ONLY person permitted to register using the Champion’s registration link. You may not use your contact information for potential participants or fill out forms for them. Failure of the potential participant to register appropriately will result in the referral payment being denied.
  • Champions shall not engage other third parties to perform Champion tasks for them.

No Employment

You acknowledge and agree that it is a fundamental term and condition precedent of your participation in the Program that you are not an employee, intermediary or agent of Care Access, and you will not hold yourself out as, or give any person reason to believe, that you are an employee, intermediary or agent of Care Access. You agree nothing in your participation, or these Referral Terms, will be construed as establishing an employment or agency relationship between Care Access and you, or creates any employment, partnership, joint venture, agency, franchise, or sales representative relationship with Care Access or our affiliates.

Payment and Taxes

Champions will receive payment of $25 USD for each eligible Qualified Referral who meets Care for Friends eligibility criteria, up to a maximum 400 referrals, or $10,000 USD.

Payments will be made within 30 days of each Qualified Referral consenting to join a Care Access program or study. While you may select a payment mechanism, the final decision as to how payments will be provided is solely determined by Care Access. Whether a payment is due is at the sole discretion of Care Access.

Tax regulations may require us to collect appropriate tax information from Care for Friends Champions (e.g., an IRS Form W-9 from U.S. persons who receive payment). Care Access will not withhold taxes from referral payments. Care Access may, at its sole discretion, require that you verify your identity using reasonable methods or require that you complete an IRS Form W-9 at any time.

Please note that after you earn $2,000 in a single calendar year, Care Access must send you an IRS Form 1099 so that you may file it with your annual taxes. You understand and agree that you are solely responsible for keeping the information in your tax forms current, complete, and accurate, and for determining your applicable tax reporting requirements. You are also solely responsible for remitting to the relevant authority any taxes due by you. Please consult your tax advisor on how this Program may impact your tax situation because Care Access cannot and does not offer tax-related advice to you.

Suspected Fraud, Tampering or Violations of the Terms

Care Access reserves the right to any remedy, including termination and/or denial of payout, if fraud, tampering, or other violations of these Terms are suspected. You agree that you will not be eligible for payments if you are in breach of these Program Terms.

Modification

Care Access reserves the right, at its sole discretion, to modify the Program at any time by posting an update on this webpage. By continuing to refer potential participants or by logging in to or using any Care Access portal, you agree that the Terms are acceptable to you and binding on you. If the modified Terms are not acceptable to you, your only recourse is to terminate your Program participation.

Termination

Care Access may terminate your participation in the Program at any time, or terminate the Program, for any reason or no reason, with or without notice. The following provisions shall survive expiration or termination of these Terms: (a) Champion’s obligation to comply with applicable law with respect to activities conducted during the Term; (b) Champion’s responsibility for all federal, state, and local taxes arising from compensation received under these Terms and for reasonable cooperation with Care Access in collecting required tax information; (c) Any obligations relating to the protection, use, or non-disclosure of confidential information or personal information obtained in connection with Champion’s activities, which shall survive for so long as Champion retains such information; and (d) Champion’s obligation to accurately represent their relationship with Care Access and not imply any ongoing affiliation or authority to act on behalf of Care Access following termination. During and following the termination of any Care Access Champion relationship, you agree not to disparage Care Access.
